1. Acceptance of Terms
By downloading, installing, or using the Evolve AI application ("App"), operated by AppsUtil ("we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
2. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that violates applicable local, national, or international laws or regulations.
- Generate, share, or store content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the App or its related systems.
- Reverse-engineer, decompile, or disassemble any portion of the App.
- Use the App to harass, stalk, or harm any individual.
- Use automated tools to scrape or extract data from the App.
3. Intellectual Property
The App, including all content, features, and functionality, is owned by AppsUtil and protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
AI-generated outputs (images, text, video) produced through your prompts may be used by you for personal purposes. You are solely responsible for ensuring your use of generated content complies with applicable laws.
4. User Content
You retain ownership of any content you submit to the App (e.g. text prompts, uploaded images). By submitting content, you grant AppsUtil a limited, non-exclusive licence to process that content solely to provide you with the requested service. We do not claim ownership of your content.
5. In-App Purchases & Subscriptions
Evolve AI may offer premium features through in-app purchases or subscriptions. All purchases are processed through the applicable app store (Apple App Store or Google Play). Prices, billing cycles, and cancellation policies are governed by the terms of that store. We do not offer refunds except where required by law.
6. Third-Party Services
The App may integrate third-party AI models and services. We are not responsible for the output, availability, or practices of these third-party providers. Your use of features powered by third-party services is also subject to their respective terms of service.
7. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate.
8. Limitation of Liability
To the fullest extent permitted by law, AppsUtil shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
9. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, via an in-app notification. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.
